FLEMING COTTAGE TERMS AND CONDITIONS

Please ensure you read and fully understand these booking terms and conditions. If anything is unclear, please contact us so we can explain in further detail to avoid any misunderstandings.  Further details and instructions are found in the digital Touchstay welcome guide which is issued to the lead guest 10 days prior to arrival. 
Bookings are subject to the following terms and conditions:
  • A contract between you and the owner will come into existence when the deposit or full payment is received, and a booking confirmation is issued showing the confirmed holiday dates.
  • We are partnered with Know Your Guest - the leading guest screening platform. We use them to independently verify our guests for every booking. Before your booking can begin, you will need to verify your details through Know Your Guest.
  • Bookings made through the online booking system are provisional until confirmed back via email.
  • Subsequent payments will be processed using the same card used to process the deposit unless otherwise notified.  The card details are stored only for the balancing payment.
  • The deposit/full payment must be paid within 3 days of any direct booking being placed.  The deposit is 25% of the full holiday cost.
  • The contract binds you (the lead booker) and all the members of the party who are part of the booking. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms and conditions. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking.
  • We require the names, ages, and contact details of all guests.
  • The balance will be processed no later than 10 days before the commencement of your holiday. If the balance is not received by the due date, then your holiday will be treated as a cancellation.
Occupancy
  • The maximum number of persons occupying the property must not exceed 6 persons and only those listed on the booking form can occupy the property. If you wish to add any infants, please check with us first.
  • Please inform us of the number of guests staying up to 7 days in advance so we can ensure the right number of beds are made up and the right number of towels are left out.  Additional bedding and towels are not freely available after check-in.
  • The home has stairs to the first-floor bedrooms so please keep this in mind if you have access issues or young children.
  • The property has a Ring camera installed to allow external monitoring of the rear gate of the property for security purposes.  If you have any concerns about this monitoring device, please speak to us at the time of booking. 
  • Please do let us know if you are bringing an electric vehicle or need charging so we can ensure the EV point is on, otherwise, it will be off and no charge available.
  • Please be advised that no extra overnight visitors are allowed to stay at the property.
  • Bookings cannot be accepted from persons under eighteen years of age.
  • The owner reserves the right to refuse a booking without giving any reason.
  • Please don't put any nappies, wipes, sanitary products, cotton buds, or pads into the toilets, or we will need to invoice you for the plumbing charge.
  • Please close and lock the front and back doors and close the windows when you are away from the property or leave the property.
  • Please leave the key in the key safe when you depart or you will be liable for the cost of a replacement set.
  • Please let us know if you are bringing a bicycle and need to use the bike shed, so we can give you the code for access and locking of the shed.
  • Please do not eat meals in the bedrooms. Any stains or mess on bedding/sofas will incur a cleaning charge.
  • We or our representatives reserve the right to enter the property at any time to undertake essential maintenance, repairs or for inspection purposes.
  • Tenancies normally commence at 15:00 on the arrival date and guests are required to leave the rental by 11:00 on the day of departure. Failure to do so may result in you being charged a further day’s rental.  If you need to arrive earlier or depart later, please check with us first and if the property isn’t being used before or after your booking, we may be able to accommodate your request.
  • You must not use the property except for the purpose of a holiday.
  • Smoking or Vaping is not allowed in the property.
  • No Pets are allowed – the home caters to guests with pet allergies.
  • Pets, vaping or smoking anywhere inside the premises will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to, and any damage or extra cleaning caused will be at your expense.
  • Damage deposit – In making a booking you accept responsibility for any theft, breakage or damage caused by you, or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. A security deposit of £200 may be requested and will be returned within 7 days of the end of your holiday, less the cost of damage/breakages.
Damages and breakages – please treat the facilities & accommodation with due care so that other guests may continue to enjoy them. If you notice something is missing or damaged in your accommodation, please let us know immediately so that we can take the appropriate action. If there has been any damage or breakages during your stay, we would be grateful if you could report them promptly, especially before check-out. The accommodation will be inspected at the end of the holiday and you may be charged for any unreasonable loss, damage or extra cleaning costs. These are to be paid for in full within 7 days of notification.
  • If damage occurs and the owner must cancel and/or refund subsequent bookings, the owner may bring a claim against you for any loss arising as a result.
  • Please do not move any furniture from one room to another or any of the indoor furniture, furnishings or bedlinen outside.
  • Please remove shoes before going upstairs and remove muddy shoes before entering the property.
  • Please lock the doors and close the windows when you leave the property unoccupied.
  • Please make sure you switch off lights, heating, or any electrical appliances when you go out – we’re an eco-friendly holiday home.
  • Please don’t take any bath towels with you outside of the house.
  • The owner reserves the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition.  The minimal cleaning charge we have quoted only covers a fraction of the actual cost we incur in cleaning and laundry.
  • Please note that if any keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you.
  • The client may in no circumstance re-let or sublet the property.
  • The owners shall not be liable to you or your holiday party for loss or damage to property, however arising.
  • All inventory must remain in the property and not be taken to another property.
  • You are responsible for the supervision of all members of your party under the age of 18 at all times.
Parking
  • Please Park your vehicles in the designated parking space, ensuring cars do not block access to other properties. Parking is limited to 2 or max 3 vehicles, which need to be parked one behind the other.
  • Please respect the community and try to keep noise levels to a minimum, especially between 10 pm and 8 am.
  • We reserve the right to terminate your rental agreement with immediate effect where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others. You’ll be asked to leave the property, without any refund of the rental amount paid.
  • Fireworks, Chinese lanterns, firepits, candles and portable BBQs are prohibited.
Check-out 
  • Towels – please place all USED towels in the laundry baskets which are hanging behind the door of the airing cupboard on the first floor.  You can leave these upstairs in the bedroom or in the kitchen.
  • Beds – we ask guests to strip the beds, but we won't give you a bad review if you don't feel this is something you can do for us.
  • Bins – Please separate food, recycling and non-recycling waste during your stay.  There are two bins in the kitchen, along with a food caddy and small biodegradable bags, as well as 30L bags for the John Lewis bins under the kitchen sink.  Our council bins are in the wooden storage unit within the back garden. The Cotswold council has a very strict recycling policy, so if you can do your bit, we will deal with the rest.  There is a separation list on the counter top.
  • Dishes – Please could you place all dirty dishes in the dishwasher and set the dishwasher to run.  All instructions are included in the guidebook. 
    
    If you want to use the services of a third-party supplier (e.g. a chef, beauty treatments) this must be agreed beforehand. If you bring a third-party supplier without consent, we reserve the right to ask them to leave. We do not accept liability for the activities of these third-party suppliers.
     
    Services
  • Wi-Fi – the guest agrees to reasonable and lawful usage.
  • Domestic electric vehicle chargers (commonly known as a ‘granny charger’ or a ‘trickle charger’) are not suitable for use at the property and are strictly forbidden. You are liable for any damage or loss suffered by us due to your unauthorised use of domestic chargers.

  • The charging point is for the use of the booking party only.
  • We do not guarantee availability and unavailability shall not constitute a breach of our booking contract.
  • Use is at the owner’s own risk, and we do not accept any liability for loss or damage sustained by you or your EV as a result of using the charger unless the damage was caused directly by our negligence.
  • You shall be responsible to us for any damage to the charging point or loss suffered by us caused by your use of the charging point.
Any problem or complaint must be immediately reported directly to us/our representatives to allow us the opportunity to resolve it.
Non-compliance with the house rules will be considered as a breach of the terms and conditions of the rental agreement. We reserve the right to terminate the booking with immediate effect and without a refund if you or your party, do not abide by the rules.
This property is privately owned and is our home. We expect all guests to enjoy the facilities and treat the property with the same respect that they would with their own home.

Illegal Activities:  We reserve the right to terminate the booking with immediate effect and without refund if we find that any guest has taken part in or allowed any of the below illegal activities to take place in or around our property.
  • Child sexual exploitation: Forcing, manipulating, or enticing someone under 18 years old, regardless of local laws, to engage in sexual activity, whether in person or online, is prohibited.
  • Human trafficking: Recruiting, harbouring, transporting, transferring, or receiving of an individual by force, fraud, or coercion for the purposes of labour or sexual exploitation is not allowed.
  • In call commercial sex work: Fleming Cottage or its surrounding property should not be used for paid sexual services, such as erotic massages or prostitution.
  • Procuring sex work: Guests should not request or offer paid sexual services.
  • Commercial pornography: Fleming Cottage or its surrounding property should not be used for the creation of commercial pornography, photos, or videos.
  • Illicit drugs: Illegal or restricted drugs such as opium, opiates, opioids, coca and cocaine, amphetamine-type stimulants, central nervous system depressants and hallucinogens shouldn’t be present or used at Fleming Cottage, or the surrounding property unless prescribed by a doctor for a medical condition.
  • Drug production or manufacturing: Fleming Cottage, or its surrounding property shouldn’t be used to produce or manufacture illegal drugs from raw materials and/or plants.
  • Drug cultivation: Fleming Cottage or its surrounding property should not be used for raising or growing plants from which illegal drugs are refined, with the exemption of cannabis.
  • Drug distribution: Fleming Cottage or its surrounding property should not be used to sell, gift, traffic or distribute drugs including cannabis, even if it is legal to do so in your area.
